Is an uncontested divorce right for me?

If you realize that your marriage isn't working, you may want out quickly. When thinking about divorce proceedings, you may think about television shows that display contentious, drawn-out court battles over precious family heirlooms - but this isn't usually the case in real life. In fact, divorce can be relatively peaceful and pain-free if you and your spouse are willing to work together through the process.

An uncontested divorce is a cost-effective option for couples who want to avoid the usual battles involving child support, alimony or property division. Let's say you are a decade or so out of college and you and your spouse have one child together. You both work good jobs and contribute equally to combined accounts. However, you haven't been able to build up a lot of assets due to student loan debt. This situation may be ideal for an uncontested divorce.

What are the benefits of uncontested divorce?

  • Spouses can make arrangements together
  • Minimized conflict
  • Lower cost compared to contested divorce
  • Couples can cite "irreconcilable differences" as grounds for divorce
  • Streamlined paperwork and proceedings

Spouses must use different attorneys through the process, but you both have a right to legal help. Attorneys can provide coaching and sit in while you and your spouse make divorce arrangements.

I'm not sure this is right for me

While there are many benefits to an uncontested divorce, it may not be right for every couple. Even when conflict is "minimized," divorce is still an emotional time. Sometimes it is okay to call for further considerations of child custody arrangements or asset division by an attorney or judge.

In those cases, a contested divorce may be worthwhile instead. A local family law attorney is trained to understand the nuances of the law to give you the best guidance through the divorce process. You can speak with an attorney to decide whether or not an uncontested divorce is right for you and your spouse.

Divorce isn't always like you see on television. Most of us are regular people who want to avoid stress and save money in our daily lives. If you and your spouse agree that your split can be a straightforward process, then you may be able to take advantage of the benefits of uncontested divorce.
